This is version 1.0. It has been checked and approved, and it is the Licence in force. This page is the frozen archived copy of version 1.0. It is never edited, because every agreement receipt carries a fingerprint of these exact words.
This is the agreement between you and us about the files and apps you buy from Chief Engineer Pro. It is written in plain words on purpose. If anything here is not clear, write to us and ask.
This Licence covers every paid Chief Engineer Pro file and app owned by your account. That means the ones you have bought already, and the ones you buy later, for as long as this version of the Licence applies.
You agree to it once. You are not asked again when you buy something new, install an app on another computer, or replace a machine. You are only asked again if we make a real change to what you are agreeing to, and then only once.
You are buying permission for one named user, and that user is you. The permission is yours. It is not a thing you can pass to somebody else, sell, lend, or hand over with an old computer.
Your right to use the version you bought does not expire. We are not going to take it away from you because time has passed.
Where the page you bought from promised lifetime updates, that promise stands. Updates we publish for the product you bought are yours, at no extra cost, and you never have to buy it again.
There are two things we cannot honestly promise for ever, and we would rather say so here than let you find out later. One is personal support and coaching, because that depends on our time. The other is an online service staying switched on, because that depends on things outside our control. If we ever have to stop running an online part of a product, we will tell you in good time and make sure you can keep what you already have.
Your purchase and your Licence are registered to you, under your name and your email address, on our records.
If you deliberately share, post, or resell what you bought, we may end your access to it.
This is aimed at deliberate sharing and reselling. It is not about an honest disagreement over support, a slow reply, or a product that did not suit you.
This does not remove any refund or consumer right given to you by law or by our published Refund Policy.
You are free to say what you honestly think of our work, in public, good or bad. An honest opinion, a poor review, and a complaint are all yours to make, and nothing in this Licence takes that away.
What this section asks is narrower than that. Please do not publish, as a statement of fact, something about us that you know is not true.
If something has gone wrong, we would like the chance to put it right first. That is an invitation, not a condition. You do not have to come to us before leaving a review, and coming to us first is never a condition of a refund.
Licence keys for eORB and Fuel CEP are tied to your email address and are yours alone. Do not pass a key to anybody else.
Our apps help you do your work. They do not replace the official record or the rules that apply to your vessel. You remain responsible for your official records, for MARPOL and flag state requirements, and for the procedures of your own company. See our Terms of Use.
We own the copyright in everything we sell. In the Philippines, copying or sharing it without permission is dealt with by the Intellectual Property Code, Republic Act No. 8293. Where an offence is committed through a computer system, Republic Act No. 10175, section 6, provides for a penalty one degree higher than the one normally imposed. That is what the law provides. Whether it applies to any particular act is a matter for a court, and not something we can promise here.
If we have to go to court over a breach of this Licence, what we may claim is limited to the loss we can actually prove, together with any costs allowed by law or awarded by the court. Nothing here creates an automatic penalty or a fixed sum.
This Licence is governed by the laws of the Republic of the Philippines.
